MAGISTRATE JUDGE ANDREW PECK
US DISTRICT COURT, SOUTHERN DISTRICT, NEW YORK

    Magistrate Judge Andrew J. Peck was appointed U.S,
    Magistrate Judge for the Southern District of New York in
    1995, and served as Chief Magistrate Judge in 2004-2005.
    Judge Peck served as a law clerk to Judge Paul Roney of
    the Eleventh (then the Fifth) Circuit, during the 1977-78
    term. He was an associate and then Counsel at the law
    firm of Paul, Weiss, Rifkind, Wharton & Garrison, from 1978-
    1995. His practice in commercial litigation emphasized
    entertainment and intellectual property (copyright and
    trademark) litigation as well as arbitration, including service
    as an arbitrator for the AAA. Judge Peck is an adjunct
    professor at Cardozo Law School, where he teaches a
    course in Pretrial Practice. Judge Peck is a frequent lecturer
    on issues relating to electronic discovery. Andrew J. Peck is
    on the Advisory Board for The Sedona Conference.

BETH NIEPOKUJ
LITIGATION SUPPORT MANAGER
PLUNKETT COONEY - DETROIT, MICHIGAN

    Ms. Niepokuj provides technical assistance to attorneys
    and paralegals who are preparing for facilitation, mediation
    and trial.  Prior to joining Plunkett Cooney, Ms. Niepokuj
    worked as the Senior Litigation Consultant and Director of
    Training for a leading litigation technology company where
    she was responsible for providing litigation consulting
    services, including software implementation
    recommendations and data analysis, as well as installation
    and configuration. She has extensive experience creating
    and presenting multimedia presentations for mediations,
    facilitations and trials. She is an expert user and trainer of
    legal software, including Summation, Trial Director,
    LiveNote, and Sanction II among others.  Ms. Niepokuj is a
    founding member and current president of the Association
    of Litigation Support Professional's (ALSP) Michigan
    Chapter.

DAVID GARRETT, ESQ.
STROZ FRIEDBERG - SAN FRANCISCO, CALIFORNIA

    David E. Garrett is Managing Director of Stroz Friedberg’s
    San Francisco office. He actively manages digital forensics
    and electronic discovery projects for major law firms and
    corporations involved in civil, criminal, regulatory, and
    internal corporate matters which often relate to
    unauthorized access, spoliation, and theft of confidential,
    proprietary, or trade secret information. Mr. Garrett has
    extensive electronic discovery experience and regularly
    consults with top executives, in-house counsel, and outside
    counsel on electronic discovery cost reduction strategies
    and legally defensible approaches to the preservation,
    collection, and production of electronic evidence.

MARCY HERONIMUS, ESQ.
SHERMAN & HOWARD - DENVER, COLORADO

    Ms. Heronimus is a partner at the Denver law firm of
    Sherman & Howard.  She has trial, arbitration and
    mediation experience in complex corporate and
    commercial cases in the areas of securities and other
    financial fraud, corporate governance, shareholder
    disputes, breach of contract and business tort litigation.  
    Additionally, she has extensive experience representing
    companies and individuals in connection with
    investigations conducted by the SEC, the Colorado
    Department of Securities, the FBI, and the United States
    Department of Justice.  Ms. Heronimus has extensive
    knowledge of and consultation of clients in e-Discovery
    issues, including document retention policies, the drafting
    and implementation of legal holds, the collection and
    utilization of electronic documents, and e-Discovery
    disputes.

    Tim Gordon, Esq. is a partner at the Denver law firm of
    Holland & Hart.  Mr. Gordon's practice focuses on the
    construction and commercial real estate industries.  Mr.
    Gordon prepares, defends, and litigates construction
    claims.  Mr. Gordon's practice also involves representing
    clients in complex construction appeals.  In addition to his
    litigation activities, Mr. Gordon is involved in project
    development early on, counseling and representing project
    owners, design professionals, and general contractors in
    the drafting and negotiating of design and construction
    contracts for a variety of project-delivery systems.

    Elleanor Chin concentrates on litigation and alternative
    dispute resolution with a particular emphasis on electronic
    discovery. She has extensive experience counseling clients
    on e-discovery and managing electronic discovery in
    complex litigation, including antitrust matters and class
    actions.  Elleanor represents clients in a number of
    industries, including telecommunications, manufacturing,
    health care and insurance, in matters ranging from
    distribution disputes to prosecution of noncompetition
    agreements.
